By accessing or using the Touchpoint Valuation platform at touchpointvaluation.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("Agent" or "you") and Touchpoint Valuation ("we," "us," or "our").
Touchpoint Valuation is a software-as-a-service (SaaS) platform that enables licensed real estate agents to:
The Service is intended for use by licensed real estate professionals. By using the Service, you represent that you are a licensed real estate agent or broker in good standing in your jurisdiction, and that you are at least 18 years of age.
ALL VALUATIONS GENERATED BY TOUCHPOINT VALUATION ARE AUTOMATED ESTIMATES ONLY. THEY ARE NOT PROFESSIONAL APPRAISALS, BROKER PRICE OPINIONS (BPOs), OR CERTIFIED MARKET ANALYSES.
Valuations are calculated using publicly available market index data including proprietary ZIP-level market data and the Federal Housing Finance Agency (FHFA) House Price Index. These estimates reflect broad market trends and may not accurately represent the current market value of any specific property.
Valuation estimates may be materially inaccurate in the following circumstances, among others:

Valuation estimates provided by the Service should not be used as the sole basis for any financial, lending, investment, or legal decision. We are not responsible for any decisions made in reliance on valuation estimates.

The Service is offered on a subscription basis at the following monthly rates:
Annual plans are available at a discounted rate equivalent to 10 months' billing. Pricing is subject to change with 30 days' notice to existing subscribers.
New accounts may access a 14-day free trial with no credit card required. At the end of the trial period, continued access requires a paid subscription.
Subscriptions are billed in advance on a monthly or annual basis. Payment is processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods. Upon cancellation, your account will remain active until the end of the paid period.
The Service, including all software, design, text, graphics, and content, is owned by Touchpoint Valuation and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own professional purposes.
You retain ownership of all client data you enter into the Service. By entering client data, you grant us a limited license to use that data solely to provide the Service to you.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy at touchpointvaluation.com/privacy.
The Service uses publicly available data from third-party sources including market data providers and the Federal Housing Finance Agency. We are not affiliated with these organizations and make no representations regarding the accuracy or completeness of their data. Third-party data is provided "as is."
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOUCHPOINT VALUATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR PROPERTY DAMAGE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT VALUATION ESTIMATES WILL BE ACCURATE.
You agree to indemnify and hold harmless Touchpoint Valuation and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms or are using the Service in a manner harmful to others or to the Service itself. You may terminate your account at any time by cancelling your subscription and contacting us at info@touchpointvaluation.com.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware, United States.
We reserve the right to update these Terms at any time. We will notify you of material changes by email or by posting a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
